Read carefully the following terms & conditions. Use of this product
constitutes your acceptance of these terms and conditions and your
agreement to abide by them.

This is a legal agreement between you, the end user, and Jibben
Software. By using this package, you are agreeing to be bound by the
terms of this agreement. If you do not agree to the terms of this
agreement and you purchased this package directly from Jibben Software,
promptly return the disk package and the accompanying items (including
written materials and binders or other containers) within thirty (30)
days to Jibben Software for a refund, less the shipping and handling
charges. Returns are subject to a 10% restocking fee. If you obtained
the software through a reseller, dealer or distributor, consult them
for their return policy.

You, the original purchaser, are granted a nonexclusive license to use
the Software under the terms stated in this Agreement. You may not use
the Software on more than one computer (i.e. a single CPU) at the same
time. You may not rent or lease the Software, but you may transfer it
on a permanent basis if the person receiving it agrees to the terms of
the Agreement. If the Software is an update, any transfer must include
the update and all prior versions.

If the package contains both 3-1/2" and 5-1/4" disk, then you may use
only the disks appropriate for your one computer. You may NOT use the
other disks on another computer or loan, rent, lease, or transfer them
to another user except as part of the permanent transfer (as provided
above) of all the Software and accompanying items.

You, the original purchaser, have a royalty-free right to reproduce and
distribute files created using the Software, provided that you (a) do
not use Jibben Software's name, logo or trademarks to market your
software product; (b) do not reverse engineer, decompile, disassemble
or modify the Software; and (c) agree to indemnify, hold harmless, and
defend Jibben Software from and against any claims or lawsuits,
including attorney's fees, that arise or result from the use of
distribution of your software product.

THE SOFTWARE AND ACCOMPANYING DOCUMENTATION ARE PROVIDED "AS IS"
WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS AND
PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.



Jibben Software will not be liable for any special, incidental,
consequential, indirect or similar damages due to the loss of data,
loss of business profits, business interruption or any other reason,
even if Jibben Software or an agent of Jibben Software has been advised
of the possibility of such damages. In no event shall Jibben
Software's liability for any damages ever exceed the price paid for the
license to use the software, regardless of the form of the claim.

This Agreement shall be construed and enforced in accordance with the
laws of the State of Minnesota. Any action or proceeding brought by
either by either party against the other arising out of or related to
the Agreement shall be brought only in a State or Federal Court of
competent jurisdiction located in Hennepin County, Minnesota. The
parties hereby agree to in personam jurisdiction of said courts.

If any provision of this Agreement is found void, invalid or
unenforceable, it will not affect the validity of the balance of this
Agreement, which shall remain valid and enforceable according to its
terms.
