AGREEMENT

As used in this documentation, the term "PROSOFT SHELL", if not followed
by a series or version designation, means any version or series of
PROSOFT SHELL provided to you now or in the future.

Your attempt to use Prosoft Shell constitutes your acceptance of the
terms set forth in the foregoing LICENSE and DISCLAIMER (which are
incorporated into this Agreement). Your attempt to use Prosoft Shell also
constitutes your agreement that if you bring any legal action relating
to Prosoft Shell,

1) Your sole remedy for the damages for which any defendant
is found liable (including direct, indirect, incidental and consequential
damages) will be the recovery of forty dollars from that defendant, and

2) You will pay the defendants' attorneys fees and other legal costs.
The terms of this agreement are governed by Wisconsin law. If any of
this Agreement's terms shall be held invalid to any extent, the remainder
of this Agreement shall be unaffected by such invalidity.

THE ABOVE PARAGRAPHS CONSTITUTE THE ENTIRE AGREEMENT BETWEEN YOU
AND ProSoft Systems. NO ORAL OR WRITTEN COMMUNICATION, INFORMATION, OR ADVICE
FROM ANY SOURCE MAY ALTER THE AGREEMENT AS SET FORTH ABOVE.
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR
OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE
ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY HAVE
OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.
