License to Use
--------------

Your first use of the Family Scrapbook software constitutes your
agreement to the following:

What is Family Scrapbook? Family Scrapbook (the Software) is a
computer program licensed by Visionary Endeavors that helps
persons record and organize genealogy and family history
information. The Software is designed to operate on IBM PC and
compatible computers under the MS/PC-DOS operating system.

Trial Use License. A limited license at no charge is granted to
any person to use and test the Software for no more than 40
calendar days. Thereafter, if you did not purchase a Customer
License directly from Visionary Endeavors, you must either pay
the license fee for a Customer License or cease all use of the
Software. You will be an infringer if you use the Software for
more than 40 calendar days without paying the license fee.

Customer License. Upon payment of the license fee, Visionary
Endeavors will grant a non-exclusive license to use the Software
by one natural person regardless of whether the license is owned
by the person or by a business (the "licensee"). Licensed
copies of the software may be kept only on computers actually
used by the licensee. No purported transfer of the license
shall be effective unless the person transferring the license
(the "transferor") (a) notifies Visionary Endeavors of the name
and address of the recipient of the license (the "transferee"),
and (b) transfers all copies of the Software and accompanying
documentation to the transferee.

The Software may not be rented, leased, modified, decompiled,
disassembled, or reverse engineered. Any such unauthorized use
shall result in immediate and automatic termination of this
license.

Limitation of Remedies. Should you encounter problems with the
Software, Visionary Endeavor's entire liability and your
exclusive remedy shall be, at the sole option of Visionary
Endeavors, either (a) to terminate the license and return any
license fees that you paid Visionary Endeavors, or (b) repair or
replace the Software.

Disclaimer of Warranties. The Software and accompanying
documentation are distributed and licensed on an "as is" basis
without warranty of any kind. The entire risk as to the results
and performance of the Software is assumed by you.

Limitation of Liability. Visionary Endeavors will not be held
liable for any damages whatsoever arising out of the use of the
Software, including without limitation any direct, incidental or
consequential damages or any damages for loss of profits,
business interruption, loss of information, or any pecuniary
loss even if Visionary Endeavors or an agent of Visionary
Endeavors has been advised of the possibility of such damages.
In no event shall Visionary Endeavor's liability for any damages
ever exceed the price paid for the license to use the Software,
regardless of the form of the claim.

All rights not expressly granted in this license are reserved to
Visionary Endeavors.

This license shall be construed and enforced in accordance with
the laws of the State of Florida. Any action or proceeding
arising out of or related to this license shall be brought only
in a State or Federal Court of competent jurisdiction located in
Duval County, Florida.

If any provision of the license is found void, invalid or
unenforceable, it will not affect the validity of the balance of
this license, which shall remain valid and enforceable according
to its terms.
